Welcome to TheirAfter ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our services, including our website, mobile applications, and any other platforms operated by TheirAfter (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.
2. Eligibility
2.1. Age Requirement:
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this age requirement.
2.2. Account Registration:
To access certain features of our Services, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary.
2.3. Custodian Role:
If you are designated as a custodian by a subscriber, you agree to fulfill the responsibilities associated with this role, including notifying TheirAfter of the subscriber’s passing.
3. Services Provided
3.1. Content Uploads:
Subscribers may upload written messages, videos, and other content (“Uploaded Content”) to be stored by TheirAfter and shared with designated recipients after their passing.
3.2. Content Sharing:
Upon notification of a subscriber’s passing by the chosen custodian, TheirAfter will distribute the Uploaded Content according to the subscriber’s instructions.
3.3. Service Availability:
We strive to provide continuous access to our Services, but we do not guarantee that the Services will be available at all times, without interruption, or error-free.
4. User Responsibilities
4.1. Account Security:
You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
4.2. Prohibited Uses:
You agree not to use the Services for any unlawful purposes or in a manner that violates these Terms. You may not upload content that is illegal, offensive, defamatory, or infringes on the rights of others.
4.3. Custodian Notification:
Subscribers must ensure that the chosen custodian is aware of and agrees to their role in notifying TheirAfter of the subscriber's passing.
5. Intellectual Property
5.1. Ownership:
All content and materials provided through the Services, including text, graphics, logos, and software, are the property of TheirAfter or its licensors and are protected by intellectual property laws.
5.2. License to Use:
Subject to your compliance with these Terms, TheirAfter grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal, non-commercial purposes.
5.3. User-Generated Content:
By uploading content to the Services, you grant TheirAfter a non-exclusive, royalty-free, worldwide license to use, store, modify, and distribute the content as necessary to provide the Services.
6. Data Collection and Privacy
6.1. Personal Data:
We collect and process personal data in accordance with our Privacy Policy. By using the Services, you consent to such collection and processing.
6.2. Advertising Data:
TheirAfter may use data collected from advertising platforms like Facebook and Instagram to improve our services and target relevant content and offers to you.
7. Payment and Subscription
7.1. Fees:
Some Services may require payment of subscription fees. All fees are non-refundable unless otherwise stated in these Terms or required by law.
7.2. Payment Methods:
You agree to provide valid payment information and authorize TheirAfter to charge the applicable fees to your chosen payment method.
7.3. Cancellation:
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.
8. Limitation of Liability
8.1. No Warranty:
The Services are provided on an “as is” and “as available” basis. TheirAfter makes no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. Limitation of Damages:
To the fullest extent permitted by law, TheirAfter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services.
9. Termination
9.1. Termination by User:
You may terminate your account at any time by contacting us at Support@TheirAfter.life. Upon termination, your right to use the Services will immediately cease.
9.2. Termination by TheirAfter:
We reserve the right to suspend or terminate your account or access to the Services at any time, with or without cause or notice.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
TheirAfter may update these Terms from time to time. Any changes will be posted on this page with an updated “Effective Date.” Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
